This paper argues that it will be important for new genomic technologies to recognize the limits of traditional approaches to informed consent, so that other-regarding implications of genomic information can be properly contextualized and individual rights respected. Respect for individual autonomy will increasingly require dynamic consideration of the interrelated dimensions of individual and broader community interests, so that the interests of one do not undermine fundamental interests of the other. This paper argues that practical wisdom represents a useful framework for understanding the synthesis of the scientific, technical, and moral dimensions of medical practice and may, therefore, guide the meaningful integration of concepts of competence and character into the education and support of both the technical and moral agency of medical professionals. The authors show the importance of practical wisdom in three distinct domains: (1) in effective deliberation in clinical judgments; (2) in helping clinicians flourish by making wise decisions in (...) light of the moral and emotional challenges they face in their practice; and (3) in helping physicians navigate between the rights of patients, the physician’s own moral good, and the objective good intrinsic to medicine. To promote the physician’s own moral good and the objective good intrinsic to medicine, the authors propose a philosophical position, the agential view, that preserves an essentialist view of medicine but emphasizes the necessity to develop a personal moral philosophy of clinical practice. The expressive power of logic is believed to be able to model most of the fundamental aspects of information retrieval. However, it is also understood that classical logic is ineffective for handling partiality and uncertainty in IR. Applying non-classical logics such as the AGM belief revision logic and the possibilistic logic to adaptive information retrieval is appealing since they provide a powerful and rigorous framework to model partiality and uncertainty inherent in any IR processes. The maxi-adjustment method, which is an (...) effective computational apparatus of the AGM paradigm, is applied to develop the learning components of the adaptive information agents. Essentially, maxi-adjustment allows the partial representation K of a user's information needs N to be refined gradually based on the user's relevance feedback t. Generally speaking, learning in adaptive information agents is characterised by the AGM belief revision Kt*. On the other hand, possibilistic logic supports a gradated assessment of the uncertainty arising from matching K with the imperfect characterisation d of an information object D. Information matching in adaptive information agents is underpinned by K ƕ d, where ƕ is the possibilistic inference relation. This paper illustrates how maxi-adjustment and possibilistic deduction can be applied to develop the adaptive information agents. While experience often affords important knowledge and insight that is difficult to garner through observation or testimony alone, it also has the potential to generate conflicts of interest and unrepresentative perspectives. We call this tension the paradox of experience. In this paper, we first outline appeals to experience made in debates about access to unproven medical products and disability bioethics, as examples of how experience claims arise in bioethics and some of the challenges raised by these claims. We then motivate (...) the idea that experience can be an asset by appealing to themes in feminist and moral epistemology, distinguishing between epistemic and justice-based appeals. Next, we explain the concern that experience may be a liability by appealing to empirical work on cognitive biases and theoretical work about the problem of partial representation. We conclude with preliminary recommendations for addressing the paradox and offer several questions for future discussion. (shrink)

In this article, we develop a non-rights-based argument based on beneficence (i.e., the welfare of individuals and communities) and justice as the disposition to act justly to promote equity in health care resource allocation. To this end, we structured our analysis according to the following main sections. The first section examines the work of Amartya Sen and his equality of capabilities approach and outlines a framework of health care as a fundamental human need. In the subsequent section, we provide a (...) definition of health equity based on the moral imperative to guarantee that every individual ought to have the freedom to pursue health goals and well-being. In the later part of the article, we outline a non-right approach to health care based on three pillars: (1) human flourishing, (2) justice as a disposition not a process, and (3) solidarity. Abstract“Suffering” is a central concept within bioethics and often a crucial consideration in medical decision making. As used in practice, however, the concept risks being uninformative, ambiguous, or even misleading. In this paper, we consider a series of cases in which “suffering” is invoked and analyze them in light of prominent theories of suffering. We then outline ethical hazards that arise as a result of imprecise usage of the concept and offer practical recommendations for avoiding them. The neurodiversity view makes both a conceptual and a political claim. Conceptually, the neurodiversity view holds that certain neurocognitive differences currently classified as disorders—autism, most notably—are best understood as forms of diversity. Politically, it holds that, rather than being medicalized and ‘treated’, neurodiversity ought to be respected in the way other human differences—such as differences in race and sexual orientation—are respected. In this article, I challenge the arguments given in support of neurodiversity’s conceptual claim, while defending its political aims of (...) respect, inclusion, and accommodation. Although neurodiversity provides a compelling challenge to the status quo, I conclude that its most prominent arguments fall short of establishing that autism is not a disorder. As I go on to argue, however, the fact that autism is a disorder does not entail that medicalization is the only course. My view is ultimately that social change and medical intervention need not be considered mutually exclusive. (shrink)

Work done within the realm of what is sometimes called ‘descriptive ethics’ brings two questions readily to mind: How can empirical findings, in general, inform normative debates? and How can these empirical findings, in particular, inform the normative debate at hand? Brick et al 1 confront these questions in their novel investigation of public views about lives worth living and the permissibility of withdrawing life-sustaining treatment from critically ill infants. Mindful of the is-ought gap, the authors suggest modestly that their (...) data ‘may be useful when constructing guidelines for clinical practice’. In this commentary, I consider some potential limitations on the generalisability of these data in the context of policy and clinical practice, limitations which may in turn serve as directions for future empirical research. The authors’ study presented participants six case scenarios, five of which involved the possibility of withdrawing life-sustaining treatment from critically ill infants. The results revealed that “[a]lmost all respondents agreed that at some level of quality of life, life may be of no benefit or worse than death for an infant” and that “participants significantly favoured withdrawal of treatment for the most severe cases.” One salient detail in these scenarios ….
